El presente trabajo propone determinadas aproximaciones iusfilosóficas al discurso jurídico, a partir de los estudios realizados por Walter Benjamin sobre Franz Kafka. La investigación se realiza con las herramientas metodológicas que aportan las “teorías críticas del derecho” y los marcos teóricos que indagan la relación “derecho-literatura”. Los textos, discusiones y apuntes realizados por el pensador alemán permiten movilizar un análisis de determinados tópicos y categorías pertenecientes al espacio jurídico. Las investigaciones que realiza en torno a la figura de Kafka ofrecen (...) insumos para indagar la formación, despliegue y conservación del derecho. Desde la obra kafkiana, Benjamin visibiliza y desarticula los conceptos nodales de justicia, ley, poder y violencia, lo que permite dar cuenta de los mecanismos y dispositivos que hacen posible el sustento mitológico del derecho. No todas las imágenes se ven. Algunas pasan tiempo escondidas, aunque acechen. Otras se camuflan o se exponen desafiantes. A veces son visibles pero apenas se perciben. Al ser producto de miradas furtivas, casi siempre son precarias y desatienden cualquier exigencia de nitidez o encuadre. Se muestran en secreto y en instantes de peligro. Es entonces cuando mutan al impactar con los cuerpos que las sienten, a los que desbordan y con-mueven. Circulan en el tiempo y transmiten saberes y memorias (...) que, al desplegarse, modifican paradigmas y verdades hegemónicas. Infringen las leyes, siendo el reverso de censuras, amenazando, como imágenes siniestras, a la belleza y al orden social. Las imágenes que conforman los imaginarios clandestinos lo revuelven todo y son salvajes, indisciplinadas, polinizantes. Sin desvelarlas del todo, este libro propone un acercamiento a algunas de sus manifestaciones a través de nueve tramas entre distintos contextos y temporalidades. Desde una imagen de un anciano durante la Guerra Civil española hasta un antiguo centro de detención en Buenos Aires en el que hoy se practica tango militante; desde los vaivenes tras la muerte de Franco, que abrieron el tiempo del que salieron los huesos del pasado, hasta las decenas de miles de negativos de la revuelta uruguaya sepultados durante décadas en unas latas oxidadas; desde las imágenes en 16 mm tras la matanza del 3 de marzo de 1976 en Vitoria hasta las casas okupas en la Holanda de los 80, donde el celuloide salvó el tiempo y las distancias con las colectividades libertarias del valle del Cinca, en Aragón, pasando por una proyección de cine clandestino durante un invierno en una parroquia de Gijón. Imágenes que no. Aplastadas por la historia pero indelebles, y que son marcos que reactivan la mirada, que afectivizan nuestros sentidos en un mundo anestesiado, enfatizando la capacidad crítica y ética que tiene el ver más allá de lo visible. Este ensayo practica una hermenéutica a Totalidad e infinitoa partir de cinco epígrafes, abocados todos a explorar los múltiples sentidos de la propuesta levinasianaen torno al fundamentotrascendental de lo ético.El primer apartado busca analizar la relación entre lo que Lévinas designa como lafaz del sery el concepto de totalidad; en el epígrafe siguiente se explicita la diferencia existente, en el interior de la comprensión temporal de lo total, entre lohistóricoy loescatológico; en eltercerepígrafe se analizan los móviles que llevan a Lévinas (...) a sustituir lo metafísico por lo ético, revelando a este segundo saber como filosofíaprimera; y, finalmente, el cuarto y el quinto epígrafe quedan dedicados a entender dos conceptos que, entrelazados, condensan la matriz conceptual desde donde Lévinas acentúa la originalidad de su propuesta: el rostro del Otroy la idea de infinito. Resumen A partir de la evidencia del fenómeno migratorio en Chile, se examina la situación de los estudiantes inmigrantes extranjeros, tomando como referencia la normativa del sistema escolar y la perspectiva del dilema redistribución o reconocimiento. En particular, el texto pretende mostrar las consecuencias de la comprensión generada por dicho dilema en relación con la dialéctica igualdad/diversidad, para explicar los efectos del discurso inclusivo sobre la situación de los estudiantes inmigrantes, considerados como paradigma de grupo minoritario. Con este propósito, se (...) distingue y analiza un particular corpus legislativo que se extiende entre los años 2009-2015, el cual se caracteriza por introducir masivamente la idea de una política educativa inclusiva como ideario a perseguir por el sistema escolar.Based on the evidence of the migration phenomenon in Chile, the situation of foreign immigrant students is examined, taking as a reference the regulations of the school system and the perspective the redistribution or recognition dilemma. In particular, the text aims to show the consequences of the understanding generated by this dilemma in relation to the equality/diversity dialectic, to explain the effects of inclusive discourse on the situation of immigrant students, considered as a minority group paradigm. With this purpose, a particular legislative corpus that extends between the years 2009-2015 is distinguished and analyzed, which is characterized by massively introducing the idea of an inclusive educational policy as ideology to be pursued by the school system. Wind turbines have been used by many groups of humans for many centuries. Wind turbines have allowed groups of humans to perform many different tasks in the past. However, only a century and a half ago, they began to be used to convert the energy captured from wind into electric energy. Moreover, only approximately twenty-five years ago, we started to introduce on a massive scale the energy generated from wind turbines into the electric networks of most developed countries in the (...) world for regular consumption. According to 2017 statistics, approximately 12 percent of the electric energy consumed in the EU is produced by wind turbines. Despite the fact that wind turbines generally appear quite similar externally—i.e., a three-blade structure, a nacelle, a tower, etc.—if we carefully examine the electric technology used within them, we find quite a wide range of technologies for energy conversion, which is a key issue in wind turbine technology. Hence, this paper adopts a dialectic perspective towards analyzing and understanding why several electric technologies coexist in wind turbine technology. We explain the specific factors that have influenced different wind turbine manufacturers to adopt different electric technologies across the last twenty-five years. We show how their actions and the technological directions that have followed have been mutually codetermined, resulting in a technological evolution that has produced today’s wind turbine variety. The aim of the present research was to assess elite student-athletes’ perception of the dual career during the lockdown caused by the coronavirus disease 2019 pandemic, compared with a group of elite student-athletes who could develop their dual career under normal conditions. A total of 150 elite athletes who were also undergraduate or postgraduate students self-completed the “Perceptions of dual career student-athletes ” questionnaire. From them, 78 did it during the mandatory lockdown period due to the state of emergency caused (...) by COVID-19 and 72 completed it in the previous year to Rio 2016 Olympic Games. The COVID-19 group was found to spend a significantly higher number of hours per week studying, while no significant differences were observed between groups in any training time variable. Student-athletes of the COVID-19 group showed better perception of whether their sport career could help them cope with their academic career and better general perception of remote learning and the use of tasks and videoconferencing as learning support tools. A lower percentage of athletes of the COVID-19 group than of the control group wished to continue with their sport career once they finished their studies. To conclude, student-athletes of the COVID-19 group show adaptations with regard to the organization of their studies and the importance they give to them and to the services provided by dual-career programs, compared with student-athletes from an ordinary pre-Olympic year. In general, student-athletes’ perception of the dual career is very positive. (shrink)

While we observe a positive relationship between membership and firm size, we also document a negative relationship between EOA membership and the executive's time in position and, to a more modest extent, accounting returns. Published in 1998, the main aim of this book is to use a naturalistic, evolutionary approach to solve some of the most important problems in philosophy. The first two problems come from the philosophy of science: the problem of rationality of science and the problem of truth in science. In presenting the first problem, the author argues that the views of Kuhn and Feyerabend do create a very serious challenge to traditional epistemology, however, if the assumption of individual rationality is (...) abandoned in favour of the author's social concept of rationality, a committed naturalism can account for science as a rational activity. In tackling the second problem of truth, the author shows that a committed evolutionary philosophy does not support realism but leads instead to a thorough evolutionary relativism of scientific knowledge. It is nevertheless possible to use this evolutionary relativism to construct a theory of relative truth. The issue of whether science discovers truth has also been tied to absolutism, that a well formulated theory of relative truth is likely to bring about a profound transformation of the way we think about the field. The author explores the notion of relative truth in the philosophy of science, ethics and aesthetics. (shrink)

This article analyzes the evolution of Philosophy of Educationin Spain and its situation at the dawn of the 21st century. Spain'speculiar socio-historical circumstances have largely conditioned thedirection this discipline has taken over the last several decades. So,although during a period there was some approximation towards themethods of analytic philosophy, Philosophy of Education has never fullyrelinquished its normative vocation. To do so would have meant spurningthe hopes and fears that had filled Spanish society by the mid 1970supon the reinstatement of civil (...) liberties and democracy. Indeed,attention to the circumstances and that normative orientation have foundtheir best fit in a practical Aristotelian-based philosophy meant toendow Philosophy of Education with a normative character that do notshun the educator's need for reflection, practical decision-making, andresponsibility. Since the 1990s, new directions have been marked by thechallenge of postmodernism, inasmuch as it affects not only thetechnological positivist model but also the reflective educator's modelof a practical Philosophy of Education. The new directions spread out invarious ways, yet they all fall into a common denominator of narrativetrends. The problem posed by these new languages lies in the extent towhich they are consistent with pedagogic intent. In turn, the answerstake on different profiles depending on whether the stance leans moretowards the philosophical or the pedagogical point of view withinPhilosophy of Education. The complementary nature of both perspectivescharacterizes the current state of the field in Spain. (shrink)

BackgroundThe COVID-19 pandemic has hit almost all countries around the globe, seriously affecting the welfare of populations. Spain is especially hard-hit. In this context, the purpose of the present study is to analyze social, demographic, and economic correlates of mental health during the COVID-19 pandemic in the population residing in Spain.MethodThe sample of this cross-sectional study was comprised of 801 participants aged 18 or older and residing in Spain. Data collection was carried out during March and April 2020. Data of (...) mental health and well-being indicators, and those of a wide number of social, demographic, and economic variables were recorded. Linear regression models were built to value associations between mental health and social, demographic, and economic indicators.ResultsMental health morbidity was higher in women, younger people, individuals with medium studies, people with fewer children, singles, students, and unemployed individuals. Positive affect was higher among women, people with a high level of studies, those not co-living with dependent seniors, the self-employed, the employed, and those working outside home. Negative affect was negatively associated with age and number of children and was higher among women, people with basic studies, singles, individuals co-living with dependent seniors, homemakers, and students.ConclusionThe most vulnerable populations were found to be women, younger people, people with basic or medium studies, students and individuals with no remunerated activities, single populations, and those co-living with dependent seniors as well as those with a reduced number of children. Descartes maintained substance dualism, the thesis that no substance has both mental and material properties. His main argument for this thesis, the so-called separability argument from the Sixth Meditation (AT VII: 78) has long puzzled readers. In this paper I argue that Descartes' independence conception of substance (which Descartes presents in article 51 of the Principles) is crucial for the success of the separability argument and that Descartes used this conception of substance to defend his argument for substance dualism from (...) an important objection. En el presente trabajo se pretende llevar a cabo una aproximación al fenómeno del colapso ecológico y su relación con la filosofía de la historia a través de las aportaciones de Walter Benjamin y Theodor Adorno. En este sentido, el fenómeno del colapso ecológico será abordado como la barbarie de nuestro tiempo, introduciéndonos en uno de los conceptos con mayor recorrido en la teoría crítica, para acto seguido explorar diversas vías filosóficas abiertas para hacerle frente en la actualidad.

El presente artículo tiene como objetivo principal presentar los principales resul- tados de una experiencia de innovación docente implementada en el 4º curso del Programa de Doble Grado en Derecho y Ciencias Políticas y de la Administración de la Universitat de València (UV). En concreto, se propuso, por parte del docente, una serie de fichas en las que se diseñaran medidas para acabar con la corrupción. Esta actividad tuvo lugar durante los meses de abril y mayo de 2022. The question of dissolution and maintenance of the state is an aspect of Hobbes’s political philosophy that has not yet received a survey to the same extent and importance usually attributed to other issues pertaining to his political writings. I emphasize in this study the English philosopher’s concern to show that the science of conserving States has the same value and scientific philosophical caliber than the science of building States. The tripartite division of this study aims to investigate first the (...) causes and the characters associated with the dissolution of the state, then the precepts and processes related to the maintenance of the State and, finally, the acts of hostilities (treason and espionage, for example) that need be known and combated by the sovereign representative because someone else affronts and contradicts the security imperative salus populi suprema lex (safety of the people is the supreme law) and the principles of reason that sustain in totum the Hobbesian public architectonic. In this chapter I shall reply to a pair of articles in which the main contention of my “Why truthmakers” – namely, that an important class of synthetic true propositions have entities as truth-makers – is rejected. In §§1–5 I reply to Jennifer Hornsby’s “Truth without Truthmaking Entities” (2005) and in §§6–7 I reply to Julian Dodd’s “Negative Truths and Truthmaker Principles” (2007).

El Tractatus de Wittgenstein es una obra desconcertante para quien la ha leído. Una vez recorridas sus complejas tesis filosóficas, sus últimos pasajes declaran que sus proposiciones se esclarecen cuando son reconocidas como sinsentidos. El libro debe ser leída como una escalera para ser arrojada una vez que hemos subido por ella. Al respecto, hay por lo menos dos posturas al respecto en la literatura: mientras la tesis de inefabilidad sostiene que el propósito del Tractatus es comunicar algún tipo de (...) verdad inexpresable a través del reconocimiento de su sinsentido, de acuerdo con la tesis terapéutica su propósito es exclusivamente identificar el sinsentido de la obra para determinar lo que resulta expresable. En este artículo defiendo una tercera opción según la cual la metáfora de la escalera ―compuesta de tres peldaños sobre la naturaleza del mundo, el lenguaje, y el sujeto― se debe entender desde su significado paradójico. El Tractatus no es una obra que intente comunicar un conocimiento teórico y, sin embargo, arrojar la obra al sinsentido lleva al lector al descubrimiento práctico de una posición ética para ‘ver correctamente el mundo’ a partir de la paradoja de un límite. Palabras clave : Sinsentido; Límite; Sujeto; Lenguaje; Escalera.: Wittgenstein’s Tractatus is a baffling work for someone who has read it. Once we have gone throughout its complex philosophical thesis, its last two passages claim that its propositions are cleared up by being recognized as senseless. The book must be read as ladder to be thrown away once we have climbed it up. In this respect, there are at least two accounts in the literature: while the ineffability view contends that the purpose of the Tractatus is to communicate some kind of inexpressible truths throughout the recognition of its senselessness, according to the therapeutic view its purpose is exclusively to identify the senseless of the work to determine what really is sayable. This article argues a third view in which the metaphor of the ladder ―having three rungs about the nature of the world, language, and the Self― must be understood from its paradoxical meaning. The Tractatus is not a work trying to communicate a theoretical knowledge and, therefore, throwing it away to the senseless takes the reader to the practical discovery of an ethical position to ‘see the world rightly’ from the paradox of a limit. Food quality is an important issue on the global agenda, particularly in high- and middle-income economies, but of little concern in designing Mexico’s food policy. Food policy has focused on quantity and in the case of maize, on satisfying domestic demand by supporting large commercial agriculture and importing from abroad. However, and as argued in this paper, obtaining a food staple of quality is also an important issue for rural households and contributes to motivating continued smallholder production. Based on case (...) studies in the rural district of Atlacomulco, in the state of Mexico, as well as in two regions of the state of Chiapas, this paper analyzes the production and consumption strategies of rural households. We focus on goals of food security and quality and note differential trends among households of varying characteristics and local contexts. We find that the motivation of small-scale producers to grow maize should be supported by Mexico’s food policy. (shrink)
